IMPORTANT NOTICE: This Agreement is subject to a binding arbitration agreement and a waiver of class action rights. Service Provider applicants have an opportunity to opt out of arbitration with respect to certain claims as provided in Section 19(j).

By using the Site or the Services, you represent, warrant, understand, agree to, and accept these Terms in their entirety, whether or not you register as a user.

1. Definitions

Defines Services, Service Provider, Client/Booker, Booking, Referring Party, Public Areas/Content, and Child/Personal Information.

2. Scope of Service

Call Emmy enables Clients seeking childcare and/or household services to find and engage qualified, independent contractor Service Providers. Your ability to obtain Services through Call Emmy does not establish Call Emmy as a provider of Services. The Services do not include medical care of any kind.

3. Modifications to this Agreement

Call Emmy may modify these Terms; continued use after changes constitutes consent.

4. Eligibility and Status

You must be 18 or older. Service Providers must be legally permitted to work in the U.S. Neither you nor any household member may have certain criminal history. Call Emmy does not employ Service Providers — Clients are the potential employers.

5. Background Checks

Call Emmy may use third parties to verify information and run background checks. You authorize Call Emmy to perform these checks.

6. Payment

Clients authorize Call Emmy to charge their payment method for Bookings, fees, taxes, and any applicable cancellation fees.

7. Non-Circumvention; Prohibited Uses; Reporting Abuse

You agree not to circumvent the Platform by hiring Service Providers off-platform after meeting through Call Emmy.

8–10. Public Content, Account Security, Child & Personal Information

You are responsible for content you post and for keeping your account secure. Special protections apply to Child Information.

11. Termination and Suspension

Call Emmy may terminate or suspend accounts at its discretion.

12–14. Third-Party Links, Intellectual Property, Copyright (DMCA)

15–16. Disclaimers and Limitation of Liability

Services are provided "as is." To the maximum extent permitted by law, Call Emmy's liability is limited.

17–18. Indemnification

You agree to indemnify Call Emmy for claims arising from your use of the Platform.

19. Dispute Resolution and Arbitration Agreement

Most disputes will be resolved by binding individual arbitration, not in court, and not as a class or representative action.
